Welcome to fit-ai. These Terms of Service govern your use of our mobile application and services. By accessing or using fit-ai, you agree to be bound by these terms.

Acceptance of Terms

By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

Service Description

fit-ai is an AI-powered fitness tracking application that helps you record workouts, track progress, and receive personalized recommendations. We strive to provide accurate and helpful information, but our app is not a substitute for professional medical or fitness advice. If you choose, you can also have a trainer look at some of your records and receive encouragement and advice (see "Trainer Sharing").

User Responsibilities

As a user of fit-ai, you agree to:

Provide accurate and complete information when creating your account.
Maintain the security of your account credentials and notify us of any unauthorized access.
Use the service in compliance with all applicable laws and regulations.
Be at least 13 years of age, or have parental consent if younger (trainer sharing is limited to people aged 18 or over).

Trainer Sharing

Trainer sharing is a feature that lets a trainer look at the records you choose and send you encouragement and advice. If you use trainer sharing, this section applies.

Definitions: In these terms, a "trainer" means an individual whom we have accepted as a trainer and who, with your consent, views your records in the categories and period you choose and sends you encouragement and advice. Trainers act in their individual capacity. "Sharing" means letting the trainer you accepted view your records in the categories and period you choose.
Starting to share: Sharing starts when you apply in the app, choose the categories and period, and agree. Neither we nor a trainer can start sharing on your behalf. What is shared and how views are recorded are described in "Sharing Your Records with a Trainer" in our Privacy Policy.
Eligibility: Trainer sharing is available only to people aged 18 or over. We may limit applications to people and numbers we decide (at first, only people we invite can use it), and may suspend or stop accepting applications or providing the feature.
Changing and stopping: You can change the categories and period or stop sharing in the app at any time. When you stop, the trainer immediately loses access to your records. The trainer or we may also end the connection.
Nature of advice: The trainer's encouragement and advice are meant to help you keep exercising and are not medical care (such as diagnosis, treatment or prescription). If you have concerns about your health, consult a doctor or other healthcare professional. The trainer may not respond to every record or message, and we do not promise when they will respond.
Messages: The trainer can send prepared phrases, a short note of up to 140 characters, and stamps. You can send prepared feeling tags and stamps.
Trainer obligations: A trainer must use shared records only to coach that person, must not pass them to others, must not use them for advertising, solicitation or sales, must not take them out by exporting or capturing the screen, and must not keep them after the connection ends. A trainer must also keep confidential what they learn, comply with the law, and not give advice that amounts to medical care. If a trainer breaches these obligations, we will suspend their use as a trainer.

Prohibited Activities

You agree not to:

Use the service for any illegal or unauthorized purpose.
Transmit harmful code, viruses, or malicious content.
Attempt to interfere with or disrupt the service or its infrastructure.
Reverse engineer, decompile, or disassemble any part of the service.
Impersonate another person, falsely claim to be a trainer, or apply for trainer sharing using someone else's account.
Use records of another person viewed through trainer sharing for any purpose other than coaching, or disclose them to others.
Harass, threaten or defame other users or trainers, or send them sexual or discriminatory content, solicitations or advertising, through messages, stamps or otherwise.
Give advice through trainer sharing that amounts to medical care, such as diagnosis, treatment or prescription.

Objectionable Content and Reports

We have no tolerance for objectionable content or abusive users. If you feel a trainer's message is inappropriate, you can end the connection in the app, which immediately stops that trainer from viewing your records and messaging you. Please also report it to support@fit-ai.jp. We review reports promptly and, where necessary, take action such as removing the content, suspending the trainer's use as a trainer, or suspending the account.

Intellectual Property

All content, features, and functionality of fit-ai, including but not limited to text, graphics, logos, and software, are the exclusive property of i-Willink LLC and are protected by copyright, trademark, and other intellectual property laws.

Disclaimer

fit-ai is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service. Always consult with healthcare professionals before starting any fitness program.

Limitation of Liability

To the maximum extent permitted by law, i-Willink LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the service will immediately cease.

Changes to Terms

We may change these Terms of Service in accordance with Article 548-4 of the Civil Code of Japan. When we do, we will announce the changed terms and the date they take effect, in the app or on our website, before that date. For significant changes, we may also ask you to agree again in the app. If you use the service on or after the effective date, you will be deemed to have agreed to the changed terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
